Terms of service

Terms and Conditions (T&Cs)

1. Scope

These General Terms and Conditions apply to all orders placed by consumers and business customers through The Indo Edit's online shop.

The online shop is operated by:

The Indo Edit
[Legal company name]
[Address]
[Postal code, city, country]
Email: info@indoedit.com
[Phone number, if available]

A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

A business customer is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their trade, business, or profession.

2. Contracting Party and Formation of Contract

The purchase contract is concluded between you and The Indo Edit.

The presentation of products in the online shop does not yet constitute a legally binding offer to conclude a purchase contract. By clicking the button labelled "order with obligation to pay" or an equivalent clearly worded button, you submit a binding offer to purchase the goods contained in your cart.

After we receive your order, you will receive an automatic order confirmation by email. This confirmation initially only documents that we have received your order. The purchase contract is concluded once we accept your order via a separate order confirmation or once we ship the goods to you.

If a product you have ordered is unavailable, we will inform you without delay. Any payments already made will be refunded promptly in this case.

3. Prices and Shipping Costs

All prices stated in the online shop include the applicable statutory value-added tax, where VAT applies.

In addition to the stated product prices, shipping costs may apply. The amount of shipping costs will be clearly displayed to you before you complete your order.

For deliveries to countries outside the European Union, additional costs may apply, in particular customs duties, import charges, or other taxes. The customer is generally responsible for these costs, to the extent permitted by law.

4. Payment

The payment methods available in the online shop are displayed during the checkout process.

The purchase price is due immediately upon completion of the order, unless otherwise stated for the respective payment method.

If payment is made via an external payment service provider, that provider's respective terms of use and payment apply in addition.

5. Delivery

Available delivery options and delivery times are stated on the respective product page or during the checkout process.

Should delivery be delayed due to circumstances beyond our control, we will inform you as soon as possible.

Should a product become permanently unavailable, we will inform you without delay and refund any payments already made in accordance with statutory provisions.

6. Retention of Title

The goods remain our property until full payment of the purchase price has been received.

7. Products and Product Representation

We make every effort to present product descriptions, images, colours, and other product information as accurately as possible.

Please note that, in particular for handmade, hand-printed, or hand-embroidered products, minor variations in colour, pattern, texture, or finish may occur. Such variations do not constitute a defect, provided they are characteristic of and reasonable for the respective production method and do not affect the agreed quality of the product.

Technical variations in colour display across different screens are also possible.

The customer's statutory rights in the event of defects remain unaffected.

8. Right of Withdrawal for Consumers

Consumers generally have a statutory right of withdrawal.

Details regarding the conditions, exercise, and consequences of withdrawal, as well as the statutory model withdrawal form, can be found in our Withdrawal Policy.

Please note that statutory exceptions to the right of withdrawal may apply to certain goods, for example goods made to customer specifications or clearly personalised to meet individual needs.

Statutory conditions and exceptions remain unaffected.

9. Statutory Liability for Defects

Statutory provisions on liability for defects apply.

In the case of defective goods, consumers are entitled in particular to the statutory rights of subsequent performance and, where the statutory conditions are met, to a reduction in the purchase price, withdrawal from the contract, or damages.

Statutory warranty rights are not restricted or excluded by these Terms and Conditions.

10. Liability

We are liable without limitation for damages arising from intentional or grossly negligent breach of duty.

We are likewise liable without limitation for damages resulting from injury to life, body, or health, as well as in all cases where liability is mandated under compulsory statutory
